On July 13, a court began in Shymkent against three civil activists, former political prisoners arrested after the January events.
In the bench of the defendants in the Al-Farabi District Court-Lyazzat Dosmambetov, Zhanmurat Ashtaev and Kairat Sultanbek.Everyone is accused under the article - “Participation in the riots” (without the use of violence).
The first court hearing was held in a small one, where there were not enough places for all persons present at the hearing.
The hearing began with the speech of the prosecutor Karataeva, who stated that the guilt of the defendants was fully proved by the materials of the criminal case and read out the prosecution.
The defense witness Tuzelbaev confirmed that the defendant Ashtaev was in the village of January 4, and the next day - at the workplace (working as a guard).
Another witness Dina Atabaeva informed the court that Dosmambetova did not participate in the rally, since on January 5 she came to the witness and she became ill with her heart.Atabaeva made a direct heart massage and called an ambulance and went to the hospital with her.From there, women called a taxi and went home.
Other declared witnesses failed to get through to interrogate them online.
After that there were the defendants of Ashtaev and Dosmambetov, who did not admit their guilt and once again confirmed: in the January events they did not participate.
The defendant Ashtaev supplemented the testimony of the witness that there are videos confirming his stay at the workplace throughout the day and he had to constantly respond to the walkie -talkie.
In contrast, Kairat Sultanbek did not hide what was really at the rally and said in the loudspeaker: “Schal Ket.Parliamentary Republic ”, after which he left the square.
As one of the evidence of his “criminal activity”, extracts from the bank account were provided, to which he said that the amount of a little more than a million tenge was transferred to him to leave the country where he was subjected to political persecution.
Another confirmation of the “criminal plan” was the printouts of wiretaps of civilian activists transmitted by the KNB.Based on the conclusion of philological and psychological examinations, they allegedly contain calls for violent actions.
Further, the presiding judge Erkebulan Tulevus announced the materials of the seven volumes of the criminal case and for a long time read messages from the cellular numbers of the defendants.The messages also had such that “it is necessary to bring” KAMAZ “with stones or at least a ishak with a cart.”
At the end of the hearing, lawyer Zholshiev asked to attach a photo taken using a screenshot to the materials of the criminal case, indicating the time of the Sultanbek and the video from the place of work of Ashatev.
Earlier, Kairat Sultanbek was sentenced to a year of restriction of freedom, Zhanmurat Ashtaev for two years, Lazzat Dosmambetov for two and a half years according to the political 405th article of the Criminal Code, according to which the democratic selection of Kazakhstan and the cat, recognized secretly from the public court of Astana as extremist, are massively held accountable.All three were recognized by the Kazakhstani human rights community by political prisoners.
