Witness testimony of Zhanar Baysagatova, the sister of one of those illegally detained during the January events in the city of Ust-Kamenogorsk.

Baisagatov Aidar was detained on January 3, 2022, at the Republic Square in the city of Ust-Kamenogorsk. There were no protests in the city that day, Aidar came to the square to shoot a live broadcast for Facebook.

Aidar was attacked by 10 people in uniforms, without any explanation and without providing documents, they handcuffed him, beat him and put him in a car.

Aidar was taken to the police station at 152 Kabanbai Batyr Street. They held him from 10 a.m. to 11:00 p.m. All the while, Aidar was beaten and tortured. They beat him on the back, spine and head with a truncheon. They strangled and beat him so that the internal organs suffered.

As a result of torture, Aidar’s fingers do not work, he gets headaches,, internal organs, groin area and kidneys hurt.

Aidar was tortured by police officers Madiev, Shotpanov, Dauthanov, Zhanseitov, and Khamitov.

In addition, during the torture of Aidar, the head of the criminal police department of the Kisanov Aset and the police colonel of the Mula Andrei Vladimirovich were in the police station.

During the medical examination, the expert Kondratiy recorded only handcuff marks on Aidar’s wrists and refused to record other injuries pointed out by Aidar.

On January 3, 2022, Aidar was arrested for 10 days under Article 488, Part 7 of the Administrative Code of the Republic of Kazakhstan (Organization and (or) holding of meetings, rallies).

On January 6, 2022, the court authorized Aidar’s arrest for a period of 2 months under Article 380, part 3, paragraph 1 of the Criminal Code of the Republic of Kazakhstan (Use of life-threatening violence against a representative of the authorities; against two or more persons).

The investigation and trials are held with numerous violations. Aidar’s lawyer and relatives are not allowed to familiarize themselves with the materials of the prosecution.

Aidar’s sister is demanding a fair investigation, punishment for the police officers who tortured him. As well as the immediate release of her brother.

Below is a full translation of the sister’s testimony:

My name is Zhanar Askerbekkyzy Baysagatova, I am a resident of the city of Ust-Kamenogorsk.

On January 3, 2022, my brother Baysagatov Aidar Askerbekuly was detained on the Republic Square of the city of Ust-Kamenogorsk. At that moment, the rally in the city had not yet taken place, and my brother was recording a video for a facebook live broadcast. Ten people, in unmarked uniforms, without providing documents and reasons for detention, handcuffed him, beat him and put him in a car. They took my brother to the police station at 152 Kabanbai Batyr Street. They held him from 10:30 a.m. to 11 p.m.

In the department there were employees Madiev, Shotpanov, Dautkhanov, Zhanseitov, Khamitov. They were all in civilian clothes and tortured my brother. They beat him with a truncheon, strangled him, hit him on the back, on the spine, on the head. They beat him to damage his internal organs. As a result of these beatings, my brother’s fingers do not work, he gets headaches, internal organs hurt, especially the groin area and kidneys suffer. We demand that he undergo a medical examination, but we are not allowed to do so. All they offer is a visual examination, and my brother needs to have an MRI of the head and an ultrasound of the internal organs. On January 3, 2022, my brother was arrested for 10 days under Article 488 part 7 of the Administrative Code of the Republic of Kazakhstan [Organization and (or) holding of meetings, rallies, demonstrations, processions, pickets or other public events held in violation of the procedure established by the legislation of the Republic of Kazakhstan on the procedure for organizing and holding peaceful assemblies]. He was held in a temporary holding facility at 2a Stakhanovskaya Street.

On January 6, 2022, the court issued my brother a warrant for arrest for two months under Article 380 part 3, paragraph 1 of the Criminal Code of the Republic of Kazakhstan [Use of violence against a representative of the authorities]. Now the arrest has been extended for another month. During this time, no investigative measures were carried out, no examination was carried out. Neither the lawyer nor I are shown video evidence of his guilt.

I would like to note that during the torture of my brother, in the police station, in addition to the five officers who beat him, there were also the head of the criminal police department of the Ust-Kamenogorsk UP Aset Kisanov and police colonel Mula Andrei Vladimirovich. They are witnesses and accomplices to my brother’s torture, as they did not obstruct or stop the torturers.

During my brother’s medical examination, Expert Kondratiy did not record all of my brother’s injuries. When my brother showed her the injuries himself, she told him not to tell her what she should write in custody. She only recorded handcuff marks on my brother’s wrists.

SWAT fighters caused harm to my brother’s health and should be prosecuted under Article 110, Part 2, Paragraph 4 of the Criminal Code of the Republic of Kazakhstan [Torture with the use of torture]. under article 146 of the Criminal Code of the Republic of Kazakhstan [Torture], under article 192 of the Criminal Code of the Republic of Kazakhstan [Robbery].

Investigators Akylgaliyeva and Sakanov should be prosecuted under Article 412 of the Criminal Code of the Republic of Kazakhstan [Bringing a knowingly innocent person to criminal responsibility].

The trials were also held in violation of the laws, my brother refused to attend them, since he was not provided with a lawyer, and the prosecutor was absent from the trial.

The order specifies the prosecutor, judge and investigator who must be prosecuted under article 414 of the Criminal Code of the Republic of Kazakhstan [Knowingly unlawful detention, remand in custody or detention], for the fact that they detained my brother for two months.

The officers who tortured my brother, Madiyev, Shotpanov, Dautkhanov, Zhanseitov and Khamitov, should be brought to justice under Articles 110 [Torture], 115 [Threat of murder], 362 [Abuse of power or official powers], 146 [Torture], 130 [Libel] of the Criminal Code of the Republic of Kazakhstan.

A forensic medical examiner should be prosecuted under article 420 [Knowingly false testimony, expert opinions, specialist or mistranslation].

Head of the Criminal Police Department of the Ust-Kamenogorsk Up Aset Kisanov and Police Colonel Mula Andrey Vladimirovich should be held accountable for failing to take action on the unlawful actions of subordinates.

I demand that my brother and other innocent people detained during the rallies be released. I demand that the investigative activities begin and all innocent people be released.

We are not given the results of forensic examinations, nor are we shown video evidence. If they have videos, they are deleted. We ask forensic scientists to give fair results, but they are afraid of pressure from law enforcement agencies. All this shows that the investigation has been conducted in violation of the law from the very beginning.

We, ordinary people, in order to get a visit to relatives from 12 at night stand in line near the detention center. People come at night, in the cold, to stand in line not only from Ust-Kamenogorsk, but also from the city of Semey, from all over East Kazakhstan, from Zaisan, from the village of Katon-Karagai.

In pre-trial detention centers, they also work in violation of the law. Clothing and other accessories handed over by relatives are not delivered to detainees. I myself had to write a statement about such violations and make sure that the things handed over to my brother were delivered to him.
